Your privacy is important to us.  This privacy policy outlines the types of information we gather about you while you are using the Buffalo Marathon website, www.buffalomarathon.org,  (the “Site”), and how we use it.  We may amend this policy at any time by posting the amended version here and updating the Effective Date of the policy to reflect the changes. 

Please read this Privacy Policy carefully.  By visiting and using this Site, you agree that your use of our Site and any dispute over privacy is governed by this Privacy Policy. 

INFORMATION COLLECTION & USE

Buffalo Marathon collects information when you voluntarily provide it for merchandise and event registration.  During the event registration process, this information includes your name, address, gender, birthdate, telephone number, and email address.  This information is necessary for event registration and to contact you.  For merchandise purchases, your name and address are collected for shipping purposes. 

CREDIT CARD INFORMATION

Credit card information is NOT collected or stored electronically by this website or the Buffalo-Erie Marathon Association.  Credit card data for electronic registration and merchandise purchases is captured and processed through RunSignUp.   We encourage you to review the privacy policy of RunSignUp at :  https://runsignup.wordpress.com/2017/01/09/runsignup-certified-pci-level-1/.


 COMMUNICATIONS FROM THE SITE

When you provide us with your email address, we will send you periodic emails regarding upcoming events, special deals and merchandise available to purchase.  Out of respect for your privacy, we provide you the option to not receive these types of communications.  If you no longer wish to receive promotional communications, you may opt-out of receiving them by following the instructions included in each communication or by contacting the Buffalo Marathon.   

HOW WE PROTECT YOUR INFORMATION

We implement a variety of security measures to maintain the safety of your personal information when you register for an event, place an order for merchandise, or enter and submit your personal information. 

INFORMATION SHARING AND DISCLOSURE

We may share aggregated demographic information about our user base with sponsors and partners, but this is not linked to any personal information that can identify any individual person. 

We do share personally identifiable information with some third parties.  We share certain event-related information with the timing companies that we hire for each event.  The timing company provides some information to the announcer at the event finish line. 

In addition, we may share your name and email address with a few third parties that offer event and runner-related services and products.  If you do not want your email address shared with these third parties, please contact the Buffalo Marathon to be removed from the list. 

LEGAL DISCLAIMER

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order or legal process served on our Site. 

LINKED SITES

Be aware that third parties/other content providers accessible through our Site may have their own privacy and data collection policies and procedures.  Buffalomarathon.org is not responsible for the actions or policies of such third parties.  You should check the applicable privacy policies of those third parties when providing information on a feature or page offered by a third party. 

COOKIES

A cookie is a small text file that is stored on a user’s computer for record keeping purposes.  Buffalomarathon.org only uses cookies to recall your login information at the merchandise store and keep track of the items in your shopping cart.

Some of our business partners (e.g., advertisers) use cookies on their sites.  We have no control over these cookies.  This privacy policy covers the use of cookies by this Site only and does not cover the use of cookies by any advertisers. 

 NOTE TO PARENTS

Our Site is directed to a general audience comprised primarily of adult Visitors and Users. Therefore, we do not typically collect Information from children under the age of 13. If BEMA creates online activities intended for children under the age of 13, the child will only be able to access the activity without providing Information. For example, children may be allowed to access child-friendly activities online (subject to offering) by entering a User Name or other non-personal login information. If we intend to collect Information from a child, we will take extra steps to protect the child’s privacy, including: (i) notifying parents about the types of Information we collect from children, how the children’s Information is used, and whether the children’s Information is disclosed to third parties; (ii) obtaining parental consent for the collection, use and disclosure of children’s Information; we reasonably verify parental consent by requesting Information from parents on portions of Our Site intended only for adults or through requesting from children a parent or guardian direct email address; (iii) giving parents the opportunity to access, review, edit, or delete the Information that We have collected from their children; we also allow parents the opportunity to refuse further collection of Information from their children, and, moreover, any children’s Information is generally stored as part of the corresponding adult’s Account with BEMA and can only be accessed by the adult Account holder; and (iv) limiting Our collection of children’s information to no more than is reasonably necessary to participate in an online activity.

CHANGES TO THIS POLICY

Buffalomarathon.org reserves the right to change this policy at any time.  Please check this page periodically for changes.  Information collected prior to the time any change is posted will be used according to the rules and laws that applied at the time the information was collected.

GOVERNING LAW

This policy and the use of the Site are governed by New York State law.  If a dispute arises under this Policy we agree to first try and resolve it with the help of a mutually agreed upon mediator in Erie County, New York.  Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us. 

If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration in Erie County, New York, under the rules of the American Arbitration Association.  Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.

Buffalomarathon.org is controlled, operated and administered entirely within New York.  This statement and the policies outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any party. 

EFFECTIVE DATE

This Privacy Policy is effective on January 25, 2017.
